Terms of Service
Last updated: [DATE]
Thanks for using Fluve. These terms are the agreement between you and [COMPANY NAME] ("we", "us"), the Spanish company that makes Fluve. They cover the Fluve apps, the website at fluveapp.com, and everything behind them (together, "Fluve").
By creating an account or using Fluve, you agree to these terms. Our Privacy Policy explains how we handle your data. If you don't agree to these terms, please don't use Fluve.
We've tried to write this in plain language. Where the law needs us to be formal, we are; the rest is as short as we could make it.
What Fluve is, and what it isn't
Fluve helps you keep track of shared and personal expenses: who paid, how a cost is split, and who owes whom.
- Fluve keeps the record; it doesn't move money. We are not a bank or a payment service, and we never hold your money. When you settle up, the payment itself happens outside Fluve, between you and the other person. Marking something as settled only updates the record.
- Balances are worked out from what people enter. If an amount, a split or a payer is wrong, the balance is wrong too. Check what you and others add.
- Currency conversions are estimates. We use published reference rates, which can differ from what your bank or card actually charged.
- Receipt scanning reads receipts automatically. It can misread an amount, an item or a date. Look over the result before you save it.
- Fluve isn't financial, tax or legal advice. Insights and summaries describe what you've recorded; they're not a recommendation.
We aren't a party to any arrangement between you and the people you share expenses with. Who owes what is between you.
Your account
- You need to be at least 14 years old to use Fluve.
- Give us accurate details, and keep your sign-in safe. You're responsible for what happens under your account. If you think someone else has got in, tell us at [CONTACT EMAIL] straight away.
- One person, one account. Accounts made by bots or other automated means aren't allowed.
- You can delete your account at any time from Profile in the app. What happens to your data when you do is in the Privacy Policy.
Groups, invites and shared content
Fluve is made for sharing, so a lot of what you add is seen by other people.
- What you add to a group is visible to everyone in it: expenses, receipts, comments, your name and your profile photo.
- Only invite people you know and who would expect to hear from you. Invites send an email in your name; don't use them to contact strangers or to advertise anything.
- Leaving a group or deleting your account doesn't erase the shared history. Expenses you were part of stay in the group, so everyone else's balances stay right; after you delete your account they show you as "Former member". The Privacy Policy says exactly what is kept.
Your content
What you put into Fluve (expenses, receipts, photos, comments) stays yours. You give us permission to store, process, copy and show it only as far as we need to run Fluve for you and the people you share it with: for example, to show your expense to the rest of your group, or to read the total off a receipt you scanned. We don't use your content for anything else, and we don't sell it.
You're responsible for what you add. Only upload things you have the right to share.
Using Fluve fairly
Please don't:
- use Fluve for anything illegal, or to harass, threaten, deceive or spam anyone, including in comments, group names and invites;
- upload content that is hateful, sexual, violent, or that infringes someone else's rights;
- use Fluve's API or any other part of our service except through the Fluve apps and website. Our API is private: it exists for our own apps and isn't a public interface. Building your own client, integration, bot or script against it, or calling it directly, isn't allowed without our written permission;
- scrape, crawl or harvest data from Fluve, or collect information about other people who use it;
- probe, scan or test the security of Fluve, or try to reach accounts, groups or data that aren't yours (if you've found a security problem, please tell us at [SECURITY EMAIL] instead; we're grateful for it);
- decompile, reverse-engineer or copy the apps, except where the law lets you regardless of what we say here;
- overload, disrupt or work around limits in the service;
- resell Fluve or access to it, or use our name, logo or design without permission.
If someone breaks these rules, we may remove content, limit what they can do, or close their account. If it's serious, or the law requires it, we may also report it to the authorities.
Beta features
Parts of Fluve may be marked as a beta, or be available only through TestFlight or early access. Those parts are still being built: they can change, move or disappear, and they may have more bugs than usual. We do our best not to lose anything, but please keep that in mind.
Price
Fluve is free to use today. If we ever introduce paid features, we'll tell you before anything costs money, and nothing will be charged without you agreeing to it first. Any purchases in the app go through Apple's or Google's payment system and follow their terms.
Changes to Fluve
We're always working on Fluve, which means features will change. We may add, change or remove features, or stop offering Fluve altogether. If we ever decide to shut Fluve down, we'll give you reasonable notice and a way to get your data out first.
If we close your account
We can suspend or close an account that breaks these terms, or when we're required to by law. Unless it's urgent or the law prevents us, we'll tell you why first and give you a chance to respond. You can always delete your account yourself from Profile.
Our responsibility
We work hard to keep Fluve available, correct and secure, but we can't promise it will always be online or free of errors. Fluve is provided "as is" and "as available".
As far as the law allows, we aren't liable for indirect or consequential loss, such as lost profits or lost data, or for losses caused by: mistakes in what you or other people enter; amounts you pay or fail to pay one another; currency conversions; or the results of receipt scanning.
Nothing in these terms limits liability that can't be limited by law, such as for gross negligence or intent, or takes away rights you have as a consumer under the law where you live.
Apple and Google
If you downloaded Fluve from the App Store or Google Play, Apple's or Google's own terms also apply to your use of the app. Those companies aren't responsible for Fluve or for supporting it; we are.
Changes to these terms
We may update these terms. When a change is significant, we'll tell you in the app or by email at least 14 days before it takes effect, and update the date at the top. Changes that add features, or that the law requires, can apply straight away. If you keep using Fluve after that, the new terms apply. If you don't agree with them, you can delete your account.
Law and disputes
Spanish law applies to these terms. If you live in another EU country, you also keep the protection of the consumer laws there.
If something goes wrong, please contact us first; most things can be sorted out quickly. You can also turn to the consumer arbitration system in Spain (Sistema Arbitral de Consumo) or the consumer authority where you live. As a consumer, you can always bring a claim in the courts where you live. [CONFIRM: whether we join the Sistema Arbitral de Consumo]
